Legal Protection for Women Workers from the Perspective of Health Law Reviewed Based on the Law on Maternal and Child Welfare in the First Thousand Days of Life Phase

Legal protection for female workers, especially regarding health during pregnancy, childbirth, and postpartum, is significant. One effort to improve this protection is through the Maternal and Child Welfare Law, especially in the first thousand days of life. After being approved by the DPR and DPD, this law was submitted to the president for ratification and implementation. Female workers often face health challenges that require legal protection, including access to maternity leave and a safe working environment, which are essential for their well-being and increased work productivity. Normative research was used to analyze existing laws and evaluate the need for change. The study results indicate that Law Number 4 of 2024 provides a strong framework to protect the health of female workers during the first thousand days of life, including prenatal, childbirth, and postpartum health services. Implementing this law is essential to ensure fair health protection for female workers, improve understanding of health rights, and integrate gender equality into health policies. Based on Law No. 4 of 2024 regarding the leave given, Maternity leave for mothers is at least the first three months and can be extended to the next three months if a doctor’s certificate evidences special conditions. This study shows that Law No. 4 of 2024 on Maternal and Child Welfare in the First Thousand Days of Life (HPK) phase has been designed to provide legal protection for women and child workers.
